This Privacy Policy applies to all users of our Website, which is used to access services.

The purpose of this Privacy Policy is to set out how, why and when Platinum Milling (Pty) Ltd (“My Adz South Africa”, “My Adz” ) uses your Personal Information so as to comply with the  Protection of Personal Information Act 4 of 2013 (“POPI”).

It is important that you read this Privacy Policy together with our other terms and conditions, privacy notices or policies we may provide from time to time when we collect or use your Personal Information.

Further, please pay special attention to the clauses in this Privacy Policy that appear in similar text and style (i.e. bold) which:

  • may limit the risk or liability of My Adz South Africa or a third party.
  • may create risk or liability for the user.
  • may compel the user to indemnify My Adz South Africa or a third party.

We respect your privacy and take the protection of Personal Information very seriously. We strive to deliver excellent service, and to do this, we need to use some of your Personal Information. This Privacy Policy describes how we handle the Personal Information we collect about you and/or receive from you. By using My Adz South Africa, you agree to the processing of your Personal Information as set out in this Privacy Policy.

In this Privacy Policy, the terms  –

  • Personal Information”, and “process/processing” bear the same meanings as set out in POPI.
  • we”, “us” or “our” refers to My Adz South Africa.
  • you” and “your” refers to every person that accesses or uses My Adz South Africa also referred to as a user.
  • registered user(s)” refers to anyone registered on My Adz South Africa and has provided us with a unique email address and password as well as other Personal Information in order to use the services on My Adz South Africa.


IF YOU ARE BELOW THE AGE OF 18

If you are below the age of 18 years, you must always get permission from your parent or guardian before you use My Adz South Africa or give us your Personal Information. We may check that your parent or guardian has given you such permission, for example by asking you to provide us with your parent’s or guardian’s contact details so we can contact them. We may also check that the contact details you have given us are correct and are the details of a person who is actually your parent or guardian. If we are not able to verify such permission or if a parent or guardian confirms that you do not have their permission, you may not use My Adz South Africa.


WHAT PERSONAL INFORMATION WE COLLECT AND PROCESS

My Adz South Africa processes Personal Information in a manner that is reasonable, adequate, relevant, non-excessive and purpose-specific. In order for users to access and use My Adz South Africa we collect and process some Personal Information. When you become a registered user, we have to collect and process your Personal Information to render our services to you.

Information from social media sites when you use those sites to register, share information or connect to your account. Those sites may automatically give us access to some personal information they hold about you (e.g., content you viewed, content you liked, and information about the advertisements you were shown or clicked on, etc.). You control the personal information we have access to through your privacy settings on the social media site and the permissions you give us when you grant us access. When you grant us access to information held by social media sites you agree that we may collect, use and retain it in accordance with this Privacy Notice.

When you register to use My Adz South Africa, we may collect the following Personal Information:

  • name and surname.
  • email address.
  • physical address.
  • mobile phone number.
  • online identifiers.
  • identification number.

Should your Personal Information change or you wish to amend and/or correct this Personal Information you can do this by updating your registered user information in your account profile.

You warrant that the information you have provided is accurate, current, true and correct and that does not impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.


Social Login

When you use social login through social networks such as Apple, Facebook, Google or Microsoft:

  • If you sign into your social network account using the same email that you previously used to register for an account with us, you will access your existing account with us.
  • If you sign into your social network account using an email address that we don’t recognise in our systems, a new account will be created in our systems for you.

You may use social login or regular sign in each time you login into your account with us. If you use regular sign in but a password has not been issued to you (because you registered through social login) you need to get a password through the password reset flow.

When you use social login the “keep me signed in” policies of the social network provider apply. We do not control those policies. For your safety we recommend that you:

  • Don’t use social login if you are accessing our Services using a public or shared device.
  • Visit your social network provider site to learn about their sign in policies and your options


Information from using My Adz South Africa

When you access My Adz South Africa, whether or not you are a registered user, My Adz South Africa processes some of your Personal Information. Depending on how you access and use My Adz South Africa, we may receive:

  • log information, through online identifiers, including information on how, when and for how long you use My Adz South Africa and other services, the content you view and search queries you submit.
  • information about the equipment you use to access or use My Adz South Africa, including the type of device you are using, how you access My Adz South Africa, your browser or operating system and your Internet Protocol address.
  • the geographic location from which you accessed My Adz South Africa, including your device’s global positioning system signal and information about nearby wifi networks and cell towers. We get this information when you use location-enabled services.

WHY DO WE PROCESS YOUR PERSONAL INFORMATION?

  • create a user account for you; and/or
  • communicate purposes and/or to provide a service to you.

As a registered user, we also process your Personal Information in order to:

  • provide you with information, services you request from us.
  • communicate with you regarding My Adz South Africa and provide you with information, products or services, including billing, customer support, resolving complaints and quality control.
  • notify you about changes to My Adz South Africa, services, terms and conditions, privacy policy or notices, and any other changes that impact My Adz South Africa, services.
  • send you information about competitions, products or services that may interest you (unless you have opted out of receiving such information).
  • get feedback from you which we need to develop our services and grow our business.
  • comply with any legal or regulatory obligations such as tax or financial laws.
  • undertake research for statistical purposes. The research and statistics we get from this process do not include your Personal Information and cannot be linked to you, nor can you be identified from these statistics.


RETENTION AND RESTRICTION OF RECORDS

We keep your Personal Information for as long as:

  • we need it to provide My Adz South Africa services to you.
  • it is required or allowed by law and is in line with our internal retention policies.
  • it is necessary to uphold the contract between you and us.
  • you have agreed to us keeping your Personal Information subject to your request for us to stop processing your Personal Information.

We will retain your Personal Information for as long as is necessary to achieve the purpose for which this information was collected or subsequently processed. If your Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires but we will stop using it for the purpose with a shorter period once that period expires.


By accessing and using My Adz South Africa, you consent to us retaining records of your Personal Information for no longer than may be necessary to achieve the purpose for which the information was initially collected or subsequently processed.


USER TRACKING AND COOKIES

When you access and use My Adz South Africa, we may use various technological tools to improve your experience on our websites through the use of cookies and/or user tracking.

Cookies are small text files placed on the device that you use to access My Adz South Africa. These files do not contain your Personal Information but allow us to associate you with a particular device. Many websites use My Adz South Africa and we use My Adz South Africa to:

You have the right to request us not to contact you for purposes of direct marketing by any form of electronic communication such as automatic calling machines, email and/or SMS notifications by “opting-out” of any direct marketing communications we may send to you.


WHO ELSE GETS TO PROCESS YOUR PERSONAL INFORMATION

We do not sell your Personal Information to third parties for their marketing or any other purposes.

We may provide or make your Personal Information available to:

  • our employees, the staff of the companies in the My Adz South Africa Group and/or third party service providers in order to enable them to assist us to interact with you.
  • law enforcement, government officials, fraud detection agencies or other third parties when the disclosure of Personal Information is necessary or appropriate in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us to legal liability or financial loss, to report or support the investigation into suspected illegal activity.
  • third parties (such as a potential purchaser and its professional advisors) in the event of any reorganisation, merger, consolation, sale, joint venture, or other disposition of any or all of our assets.
  • our service providers (under contract with us) who help with parts of our business operations (fraud prevention, marketing, public relations, technology services etc). However, our contracts dictate that these service providers may only use your Personal Information in connection with the services they perform for us and not for their own benefit or any other purpose, and must treat such information as confidential information.
  • the companies in the My Adz South Africa Group in order for them to send you once-off opt-in direct marketing communications.


SENDING YOUR PERSONAL INFORMATION OUTSIDE SOUTH AFRICA

We may transfer certain Personal Information outside the geographic borders of South Africa to service providers for purposes set out above (Why we process your Personal Information?), including for data storage and back-up purposes to ensure the integrity of our systems.

When we transfer your Personal Information outside of the geographic borders of South Africa, we will ensure that we do so in accordance with the requirements for lawful transfer outside of South Africa as set out in POPI.

By accessing and using My Adz South Africa, you consent to us transferring your Personal Information outside of South Africa as set out in POPI.


SECURING YOUR PERSONAL INFORMATION

We secure the integrity and confidentiality of your Personal Information in our possession or under our control by taking appropriate, reasonable technical and organisational measures to prevent loss of, damage to or unauthorised destruction of Personal Information; and unlawful access to or processing of Personal Information.

In order to implement and maintain such measures, we have in place policies, controls and related processes, which are reviewed and updated on a regular basis. Our policies, controls and procedures cover for example:

  • physical, technical and network security.
  • access controls and monitoring of access.
  • secure storage, destruction and encryption of records of Personal Information.
  • Personal Information breach reporting and remediation.
  • by way of written agreements, imposition of security and confidentiality obligations on third parties (based within or outside the borders of South Africa) who process Personal Information as part of rendering services to us.

Should you disclose your Personal Information to any third party other than My Adz South Africa, My Adz South Africa shall not be liable for any loss or damage arising or suffered by you as a result of the disclosure of such Personal Information to any third party. This is because we do not regulate or control how that third party uses your Personal Information. You should always ensure that you read the privacy policy of any third party.


KNOW YOUR RIGHTS

Having provided adequate proof of your identity, you have the right to:

  • view, correct and/or amend your Personal Information we process. Please note that as a registered user, you can do this through your user account for the Personal Information reflected therein.
  • request a record or description of your Personal Information.  My Adz South Africa may charge a fee in order to provide you with this record of your Personal Information. Where requests to access and amend your Personal Information are manifestly unfounded, excessive or repetitive My Adz South Africa may charge an additional administrative fee or refuse the request.
  • request to have your Personal Information corrected, destroyed or deleted. Please note that you can stop being a registered user by cancelling your account. In this instance Cookie will only retain your Personal Information subject to any legislative requirement and/or our internal retention policy.
  • us complying with your requests upon receipt unless we have credible reason why we cannot comply.
  • us indicating where, if we cannot agree whether to correct or delete your Personal Information as requested, that a correction or deletion was requested but was not made.
  • inform you if reasonably practicable,  should we change your Personal Information and this has an impact on decisions about you.
  • notify you of the action taken by us because of your request.
  • notify you of unauthorised access to your Personal Information.
  • provide you with reasonable evidence of our compliance with our obligations under this Privacy Policy on reasonable notice and request.
  • Submit a complaint to the Information Regulator.

Community Guidelines

The My Adz South Africa Marketplace (“Marketplace”) is built on trust, transparency and respectful interactions between buyers and sellers.

These Community Guidelines establish the standards expected from all users who participate in the Marketplace, including buyers, sellers, businesses and service providers.

By using the Marketplace, you agree to follow these guidelines, treat other users fairly, and contribute to a safe and reliable online buying and selling environment.

My Adz South Africa (“My Adz”, “we”, “our” or “us”) reserves the right to remove content, restrict accounts, suspend users or take appropriate action where these guidelines are violated.

Respectful Communication

All users must communicate respectfully and professionally.

Users may not:

  • Harass, threaten or intimidate other users.
  • Use abusive, offensive or discriminatory language.
  • Send unwanted repeated messages.
  • Make personal attacks.
  • Attempt to pressure or manipulate another user.
  • Share private conversations without permission.

Healthy communication helps create a safer marketplace for everyone.

Honest Listings

Sellers must ensure that all listings are accurate and truthful.

Listings must:

  • Clearly describe the product or service.
  • Use accurate images.
  • State the correct condition of items.
  • Include relevant information buyers need to make informed decisions.
  • Disclose known faults or defects.

Sellers may not:

  • Misrepresent products.
  • Use misleading titles or descriptions.
  • Advertise items they do not have.
  • Use fake images.
  • Hide important information.

Authentic Products

Sellers must only list genuine products they are legally permitted to sell.

Users may not:

  • Sell counterfeit goods.
  • Claim products are genuine when they are not.
  • Misuse brand names or trademarks.
  • Sell unauthorised copies.

Listings suspected of being counterfeit may be removed.

Fair Buying Practices

Buyers are expected to:

  • Review listings carefully before purchasing.
  • Provide accurate information.
  • Communicate clearly with sellers.
  • Complete purchases they commit to where possible.
  • Follow Marketplace processes when raising concerns.

Buyers may not:

  • Abuse refund systems.
  • Submit false complaints.
  • Damage products and claim they arrived damaged.
  • Threaten sellers to obtain refunds.

Fair Selling Practices

Sellers are expected to:

  • Provide good customer service.
  • Dispatch products within stated timeframes.
  • Respond to buyer enquiries.
  • Honour accepted orders.
  • Resolve problems professionally.

Sellers may not:

  • Cancel orders unfairly.
  • Create fake accounts.
  • Manipulate ratings or reviews.
  • Avoid Marketplace fees.
  • Move transactions outside the Marketplace to bypass protections.

Reviews and Ratings

Reviews help maintain trust within the Marketplace.

Reviews must be:

  • Honest.
  • Based on genuine experiences.
  • Relevant to the transaction.

Users may not:

  • Post fake reviews.
  • Buy or sell positive reviews.
  • Threaten users to influence reviews.
  • Post misleading information.
  • Use reviews for personal attacks.

My Adz may remove reviews that violate these guidelines.

Prohibited Communication and Transactions

Users should keep Marketplace transactions within approved My Adz channels where applicable.

Users may not use the Marketplace to:

  • Arrange illegal transactions.
  • Request personal financial information.
  • Share harmful links.
  • Conduct scams.
  • Promote prohibited services.
  • Attempt to avoid Marketplace protections.

Fraud Prevention

Users must not participate in fraudulent activity, including:

  • Fake listings.
  • Fake payment confirmations.
  • Identity impersonation.
  • False claims.
  • Payment scams.
  • Misleading advertisements.
  • Account sharing.

Suspicious activity may be investigated and reported where required.

Personal Information Protection

Users must respect the privacy of others.

Users may not:

  • Share another person’s personal information without permission.
  • Publish private messages.
  • Request unnecessary personal details.
  • Misuse contact information obtained through the Marketplace.

Users should protect their own personal information and avoid sharing sensitive information unnecessarily.

Business Conduct

Businesses using My Adz must:

  • Provide accurate business information.
  • Advertise lawful products and services.
  • Follow consumer protection requirements.
  • Maintain professional communication.

Businesses may not:

  • Create misleading advertisements.
  • Impersonate other companies.
  • Use deceptive marketing practices.

Spam and Unwanted Content

Users may not:

  • Post duplicate listings excessively.
  • Create spam advertisements.
  • Upload irrelevant content.
  • Manipulate search results.
  • Flood users with unwanted messages.

My Adz may remove duplicate or excessive listings.

Account Security

Users are responsible for maintaining the security of their accounts.

Users should:

  • Keep login information confidential.
  • Use accurate account information.
  • Notify My Adz of suspicious account activity.

Users may not:

  • Share accounts.
  • Access another user’s account.
  • Attempt to bypass security systems.

Reporting Violations

Users are encouraged to report:

  • Suspicious listings.
  • Fraudulent activity.
  • Abusive behaviour.
  • Prohibited items.
  • Policy violations.

Reports should include relevant details and supporting information where available.

My Adz reviews reports and may take appropriate action.

Enforcement Actions

Where users violate these Community Guidelines, My Adz may:

  • Remove listings.
  • Remove content.
  • Limit account features.
  • Restrict Marketplace access.
  • Hold transactions where permitted.
  • Suspend accounts.
  • Permanently terminate accounts.
  • Cooperate with legal authorities where required.

The action taken will depend on the seriousness and frequency of the violation.

Zero Tolerance Areas

My Adz has zero tolerance for:

  • Fraud.
  • Scams.
  • Illegal activities.
  • Threats of violence.
  • Exploitation.
  • Hate-based content.
  • Child exploitation.
  • Identity theft.
  • Criminal activity.

Such activity may result in immediate account termination and may be reported to relevant authorities.

Seller Verification (KYC) Policy

This Seller Verification (Know Your Customer or “KYC”) Policy explains the verification requirements for individuals and businesses wishing to sell products or services through My Adz South Africa.

My Adz South Africa (“My Adz”, “we”, “our” or “us”) is committed to maintaining a safe, secure and trustworthy Marketplace by verifying the identity of sellers, reducing fraud and complying with applicable South African laws and payment provider requirements.

By registering on My Adz South Africa, you agree to comply with this Seller Verification (KYC) Policy.

Purpose of Verification

Seller verification helps My Adz to:

  • Confirm the identity of sellers.
  • Reduce fraud and identity theft.
  • Protect buyers and other Marketplace users.
  • Verify ownership of payout bank accounts.
  • Comply with legal and regulatory obligations.
  • Prevent money laundering and financial crime.
  • Maintain the integrity of the Marketplace.

Verification does not constitute an endorsement or guarantee of a seller or their products.

Who Must Complete Verification?

Seller verification may be required for:

  • Individual sellers.
  • Sole proprietors.
  • Registered businesses.
  • Companies.
  • Partnerships.
  • Non-profit organisations.
  • Any seller receiving Marketplace payouts.

My Adz reserves the right to require verification before or after a seller begins trading.

Information We May Request

Depending on the type of seller, My Adz may request one or more of the following:

Individual Sellers

  • Full name.
  • South African ID or passport number.
  • Date of birth.
  • Residential address.
  • Contact number.
  • Email address.
  • Proof of address.
  • Selfie or identity verification photograph where required.

Business Sellers

  • Registered business name.
  • Company registration number.
  • VAT number (where applicable).
  • Registered business address.
  • Business contact details.
  • Details of authorised representatives.
  • Proof of business registration.
  • Additional documents required for verification.

Bank Account Verification

Before receiving Marketplace payouts, sellers may be required to verify that the nominated bank account:

  • Is active.
  • Is held in the seller’s name or the registered business name.
  • Matches the verified account holder.
  • Can lawfully receive electronic payments.

My Adz may request:

  • Bank confirmation letters.
  • Cancelled cheques (where accepted by the bank).
  • Recent bank statements.
  • Other reasonable proof of account ownership.

Payouts will only be made to verified bank accounts.

Verification Process

Seller verification may include:

  • Automated identity verification.
  • Manual document review.
  • Bank account verification.
  • Business registration checks.
  • Address verification.
  • Fraud screening.
  • Sanctions and compliance screening where legally required.

Verification timeframes may vary depending on the information provided.

Additional Verification

My Adz may request further verification where:

  • Information appears inconsistent.
  • Fraud is suspected.
  • Selling activity changes significantly.
  • High-value transactions occur.
  • Legal or regulatory requirements change.
  • Additional compliance checks are required.

Failure to provide requested information may result in delays or restrictions.

Seller Responsibilities

Sellers agree to:

  • Provide accurate and truthful information.
  • Keep verification information up to date.
  • Notify My Adz of significant changes to their details.
  • Cooperate with verification requests.
  • Submit requested documentation within a reasonable period.

Providing false, misleading or fraudulent information is strictly prohibited.

Verification Outcomes

Following review, My Adz may:

  • Approve the seller.
  • Request additional information.
  • Place the application under further review.
  • Restrict Marketplace functionality.
  • Decline seller verification where requirements are not met.

Verification decisions are made at My Adz’s reasonable discretion, subject to applicable law.

Payout Restrictions

My Adz may withhold or delay Marketplace payouts where:

  • Verification is incomplete.
  • Verification documents have expired.
  • Banking information cannot be verified.
  • Fraud investigations are ongoing.
  • Legal or regulatory obligations require a delay.
  • A dispute affects the seller’s account.

Payouts will generally resume once outstanding verification requirements have been satisfied.

Ongoing Monitoring

Seller verification is not a once-off process.

My Adz may conduct periodic reviews to ensure that seller information remains accurate and up to date.

Sellers may be asked to reconfirm or update their information from time to time.

Data Protection

Personal information collected during the verification process will be processed in accordance with:

  • The Protection of Personal Information Act, 2013 (POPIA).
  • The My Adz Privacy Policy.
  • Applicable South African laws.

Verification information will only be used for legitimate business, legal and security purposes.

Confidentiality

Verification documents are treated as confidential and will only be accessed by authorised personnel or trusted service providers who require the information to perform verification, payment processing or legal compliance functions.

Information will not be disclosed except where:

  • Required by law.
  • Required by a court order.
  • Required by a regulatory authority.
  • Necessary to prevent fraud or unlawful activity.
  • Permitted under our Privacy Policy.

Fraud and Misrepresentation

My Adz has zero tolerance for:

  • Identity theft.
  • Forged documents.
  • Stolen identities.
  • False business registrations.
  • Fake bank account information.
  • Impersonation.
  • Misrepresentation during verification.

Such conduct may result in:

  • Immediate suspension.
  • Permanent account termination.
  • Cancellation of pending payouts.
  • Reporting to the appropriate authorities.
  • Legal action where appropriate.

Appeals

A seller whose verification is declined or whose account is restricted may contact My Adz to request a review and submit additional supporting information.

Submission of additional information does not guarantee approval.


HOW TO LODGE A COMPLAINT WITH THE INFORMATION REGULATOR

If you have any complaints about this Privacy Policy or our compliance with this Privacy Policy you can lodge a complaint with the Information Regulator.

This version of the Privacy Policy replaces any preceding privacy policy provisions on our website. We may occasionally update this Privacy Policy. When you use our Platforms the version of the Privacy Policy posted on this page applies to you.
